High Court Gives New Directive on Impeachment Motion Against Gachagua
The High Court in Kerugoya has mandated the National Assembly to conduct an additional public participation session concerning the impeachment motion aimed at Deputy President Rigathi Gachagua.
In a ruling delivered on Thursday, October 3, Justice Richard Mururu Mwongo instructed that these public participation sessions should be organized at the constituency level.
Justice Mwongo emphasized that the upcoming session scheduled for Friday, October 4, can move forward as an initial step in the process. Following this, the National Assembly is required to arrange another round of public participation that is more accessible to the public.
He stated, “The public hearings planned for 4th October 2024 are permissible as the preliminary stage of public involvement, and the respondents, numbered from the first to the fifth, are tasked with organizing comparable public hearings in closer proximity to the citizens, specifically at the constituency level in each region of Kenya. This is to ensure that the constituents represented by their Members of Parliament, who are integral to the impeachment process on a national scale, have the opportunity to engage and participate in these hearings or other appropriate methods that allow citizens at this level to contribute their views.”

Justice Mwongo further highlighted the importance of genuine public participation, indicating that it must go beyond mere formality to genuinely involve the community in the democratic process.
His ruling signifies a critical step in ensuring that the voices of citizens are not only heard but actively incorporated into significant political proceedings such as impeachment motions.
The directive reflects the judiciary’s commitment to upholding democratic principles and ensuring that elected representatives are held accountable to their constituents.
By mandating this additional layer of public involvement, the court aims to enhance transparency and foster greater civic engagement in matters that directly impact the political landscape of the country.
