Gachagua’s Legal Team Reveals Ultimate Plan to Save Deputy President

Deputy President Rigathi Gachagua is preparing for a legal showdown to defend his position as he awaits the Senate’s decision on his fate. He has rallied a strong legal team to fight his removal from office.

This follows a significant vote in Parliament on Tuesday, where 281 MPs backed Gachagua’s impeachment, exceeding the constitutional requirement of 117 MPs for the motion to proceed to the Senate.

Gachagua’s legal team has expressed interest in taking the matter to the Supreme Court due to the seriousness of the charges.

Led by seasoned lawyers Paul Muite and Fred Ngatia, the team is pushing for Chief Justice Martha Koome to form a three-judge panel to oversee the case.

The legal team argues that the impeachment process is too important to be decided based solely on parliamentary votes. Paul Muite emphasized that the Constitution of Kenya gives sovereign power to the people who elected the president and deputy president.

Reports suggest Gachagua will enlist around 20 law firms to mount a strong legal defense against the 11 charges he’s facing.

The Law Society of Kenya (LSK) has also joined the legal battle to challenge the impeachment.

The Senate has scheduled the hearing of the impeachment motion for Wednesday 16th and Thursday 17th next week, opting for a plenary session rather than a special committee to allow all 47 senators to hear the case.

Senate Minority Leader Edwin Sifuna opposed the formation of a special committee, leading to the decision for a plenary hearing. To remove the deputy president, two-thirds of the Senate must vote in favor, though Gachagua’s team is prepared to appeal the decision in court.
