    Fresh Twist: Italian Petitions, Denies Selling 1,000-Acre Land to Late MP Kirima

    The High Court has been petitioned to suspend the Environment and Land Court’s decision that ordered the Kirima family to evict thousands of residents from nearly 1,000 acres of land in the Njiru, Chokaa, and Mihango regions.

    In court documents, the petitioners assert that forged documents were presented to the court and that the Kirima family obtained the judgment fraudulently.

    One of the petitioners, who is the administrator of the estate of Dominico De Masi, the man who allegedly sold the land to the late politician Gerishon Kirima, moved for stay orders in court, contending that they did not sell the land to the deceased politician.

    โ€œThe Honorable Court was presented with fake documents and the Respondents obtained the judgment through fraud,โ€ read the court documents.

    โ€œIt is in the interest of the Honorable Court to protect its sanctity and integrity to order for review of the judgement and allow the Applicant to present the available evidence and exonerate the court from the possibility of relying on fake documents.โ€

    In his application, Bernado Vicezo De Masi, an Italian national, requests to be joined in the lawsuit.

    He is also requesting a review of the October 23 judgment issued by Justice S. Okong’o, which ordered the occupants of LR. No. 5908/8 to vacate the property by December 31, failing which the Kirima Estate Administrators should evict them.

    The administrator has also refuted claims that he sold the land to the late Kirima in the 1970s and stated that he has been negotiating with the squatters occupying their land to resolve.

    The comments follow similar statements made by Embakasi East MP Babu Owino on Friday, who asserted that the disputed 1,000 acres of land in the Njiru, Chokaa, and Mihango areas do not legally belong to the late Starehe MP.

    MP Babu asserted that the original proprietor of the land was an Italian national who, in 1966, purchased it from a man of Indian descent, and vowed to contest the eviction threat in court.
