    Senator and former two-term governor of Uasin Gishu Jackson Mandago will spend the night in police custody before his arraignment on August 17.

    What are Jackson Mandago’s charges? 

    Wednesday, August 16, the court issued an arrest warrant for the politician after he failed to appear in court to answer several allegations of theft and abuse of office.

    Mandago is accused of conspiring with Meshack Rono, Joseph Kipkemboi Maritim, and Joshua Kipkemboi to perpetrate a felony in violation of Section 393 of the penal code on various dates in 2021.

    Details on the charge sheet indicate that on various dates between March 1, 2021, and September 12, 2021, while in Uasin Gishu county, the four, along with others not before the court, conspired to steal KSh 1.1 billion from an account at the Eldoret branch of Kenya Commercial Bank.

    Abuse of office matters

    The politician is also expected to be charged with abuse of office in violation of section 101 as read with section 102 (A) of the Kenyan penal code, CAP 63 Laws of Kenya.

    Mandago is accused of representing fraudulently as a public official that the Uasin Gishu Overseas Education Trust Account was being opened for the Uasin Gishu county government, an act that was detrimental to the county government.

    A petition by parents was investigated by the Uasin Gishu County Assembly, which concluded that the account was not for the devolved unit.

    Unauthorized entry into MOU

    In a second count of abuse of office, Mandago is accused of engaging in a Memorandum of Understanding on behalf of the county with universities in Finland and Canada.

    According to the indictment, the accused decided while serving as governor. This action is regarded illegal because it was not approved by the County Assembly’s resolution, and is therefore detrimental to the Uasin Gishu County Government.

    Misrepresenting municipal administration

    This charge was included in the particulars of a separate count of abuse of office. Senator Mandago is accused of arbitrarily misrepresenting that the county administration of Uasin Gishu provided students with full scholarships to study in Finland and Canada.

    The prosecution indicated that Mandago committed this deed while serving as governor of Uasin Gishu.

    In the final count of abuse of office, the prosecution accuses Mandago of unilaterally seconding county government employees to the Uasin Gishu Overseas Education Trust program.

    The prosecution alleges that the staff drew salaries from the Uasin Gishu county administration, which was detrimental to the county’s residents.

    The four are scheduled to respond to the allegations on Thursday, August 17, before a court in Nakuru.
