    Man Sentenced to 20 Years for Ksh780 Theft and Robbery

    On Thursday, July 6, the Makindu Magistrates Court sentenced a man who stole Ksh780, clothing, and a pair of shoes to twenty years in prison.

    Senior Principal Magistrate Ireri found Boniface Maingi guilty of armed robbery for an incident that occurred in Emali Township, Makueni County, on January 18, 2020.

    “Boniface Maingi was found guilty of robbing the complainant of a mobile phone, assorted clothing, a pair of shoes, and Ksh 780 in Emali township,” ODPP stated in a statement.

    The prosecution, led by Catherine Ngari, established its case through the testimony of four witnesses.

    The prosecutor used police reports, eyewitness accounts, and circumstantial evidence to link Maingi to the crime scene in Makueni County.

    Ngari informed the court that detectives had secured the crime scene and ensured the safety of the victim and any witnesses.

    Section 296 (2) of the Kenyan Penal Code defines robbery with violence as an incident in which the offender is armed with a dangerous or offensive weapon or instrument or is in the company of one or more other persons, or if, at or immediately before or after the time of the robbery, he wounds, beats, or uses any other form of personal violence against any person, he is subject to life imprisonment.

    This section of the Penal Code makes it a more serious crime to commit robbery while armed, in the company of others, or through the use of force against the victim. Life in prison is the maximum penalty for robbery with violence.

    The distinction between robbery with violence and simple robbery is significant because the penalties for robbery with violence are much harsher.

    Notably, section 296 (2) does not apply to all robberies that involve violence. The maximum sentence for simple robbery is 14 years in prison.
