    AG Appeals High Court Ruling on Ruto’s CAS Appointments

    Attorney General Justin Muturi has lodged a notice of appeal regarding Monday’s ruling by the High Court that invalidated the appointment of fifty Chief Administrative Secretaries (CASs) by President William Ruto.

    This matter, which has been deemed to be of the utmost importance, is scheduled to be discussed in front of Lady Justice Mugure Thande on Wednesday morning at nine in the morning.

    The judges Kanyi Kimondo, Hedwig Ong’udi, and Aleem Visram ruled on Monday that public participation in the creation of the CAS posts was only conducted for 23 occupants and that the creation of the additional 27 occupants did not adhere to the constitutional requirement of public participation. They stated that their decision was based on the fact that public participation in the creation of the CAS posts was only conducted for 23 occupants.

    The court stated, “Once that office was abolished on 21 September 2022, the newly-created office and complement of 23 office holders could no longer benefit from that stay.” This was said while also noting that the position had been eliminated the previous year.

    “For the newly-created office and the fresh complement of 50 to be lawfully established, they were required to comply with the constitution as well as the criteria that were established earlier in Okiyah’s case. They did not follow the rules. According to the ruling of the court, “the entire complement of 50 CASs is therefore unconstitutional.”
