Raila’s Lawsuit Halts Shakahola Commission: Court Orders Suspension
Monday, the High Court suspended the Shakahola Commission’s operations for seven days pending a ruling that will be issued next week.
This is because the Azimio coalition, led by opposition leader Raila Odinga, filed a lawsuit to prevent it from convening.
The coalition filed the lawsuit two weeks ago, arguing that President William Ruto’s appointment of the eight-member team is illegal and a violation of the Constitution’s allocation of powers to other state organs.

By appointing the team, according to Azimio, the Head of State usurped the authority of the national police service to conduct investigations.
In addition, the coalition argues that the move undermines the authority of Inspector General of Police Japhet Koome, who is not only obligated to conduct investigations but also prohibited from taking orders from anyone regarding whom to investigate.
In addition, the petition accuses Dr. Ruto of empowering his appointees to undermine the constitutional mandate and authority of constitutional institutions and state organs.
Dr. Ruto appointed the commission on May 4 and named Court of Appeal judge Jessie Lesiit as its chairperson to investigate the deaths, torture, and inhuman and degrading treatment of victims associated with the Good News International Church in Kilifi – specifically pastor Paul Mackenzie.
