    Court Rules on Arrest of Ndiangui Kinyagia

    Court Rules on Arrest of Ndiangui Kinyagia

    Blogger Ndiangโ€™ui Kinyangia, who had been missing for several days, finally appeared in court on Thursday morningโ€”bringing an emotional end to the desperate search led by his family, lawyers, and concerned citizens.

    His mother, Lilian Wanjiku, was present in court as the judge gathered to decide what steps to take next. Kinyangiaโ€™s lawyers said he looked โ€œsick and traumatizedโ€ and was unable to fully participate in the legal proceedings.

    Speaking on behalf of the family, Lawyer Kibe Mungai told the court that fellow advocate Wahome Thuku had informed him of Kinyangiaโ€™s location on Tuesday night. The family also managed to speak with him by phone the evening before he appeared in court.

    โ€œYour Honour, weโ€™ve finally found him. But heโ€™s clearly unwell,โ€ said Kibe, adding that neither the family nor the legal team had the chance to discuss what happened to him while he was missing.

    Due to Kinyangiaโ€™s physical and mental state, the lawyer asked the court to postpone the case so they could privately speak with him.

    โ€œIโ€™m afraid I canโ€™t assist the court until weโ€™ve had a proper session with him to understand the situation,โ€ Kibe added.

    The legal team also raised concerns that Kinyangia might be detained again. They asked the court to issue an order to stop any future arrestโ€”a request the court granted. The lawyer further proposed that Kinyangia be released on bond and attend court when required.

    โ€œThe family has asked for more time, which is reasonable. We can resume once heโ€™s recovered and ready to participate,โ€ the court was told.

    Justice Chacha Mwita agreed with the request, stating that Kinyangiaโ€™s appearance in court had fulfilled the key goal of locating him.

    โ€œMy intention was to ensure heโ€™s found and presented before the public. Now that heโ€™s here, itโ€™s important to allow the family and lawyers time to talk to him,โ€ said Justice Mwita.

    However, the Attorney Generalโ€™s office, represented by lawyer Emmanuel Bitta, complained that they hadnโ€™t been treated fairly and requested a chance to give their side.

    The court granted the family permission to take Kinyangia to hospital, with the next hearing set for July 18.
