    High Court Orders Government to Appoint Nzau Musau and Lucy Minayo to Media Complaints Commission

    High Court Orders Government to Appoint Nzau Musau and Lucy Minayo to Media Complaints Commission

    The High Court has ordered the Cabinet Secretary for Information, Communications and the Digital Economy to officially appoint and publish the names of journalist Nzau Musau and lawyer Lucy Minayo as members of the Media Complaints Commission within 14 days.

    This comes after the two filed a legal challenge, arguing that although they were shortlisted and interviewed for the positions, they were unfairly left out of the final appointments. Justice Bahati Mwamuye, who presided over the case, agreed with them and ruled that their exclusion violated their constitutional right to fair administrative action.

    In a firm judgment, the court also blocked the government from choosing or recognizing anyone else for the roles and cancelled a previous letter that had declared the two unfit for the commission. The judge noted that Musau and Minayo were not given a chance to defend themselves against the claims made in the rejection

    โ€œA declaration is hereby issued that the exclusion of the petitioners from appointment, despite being duly nominated, was a violation of their constitutional rights,โ€ Justice Mwamuye stated.

    The Ministry had claimed that background checks raised concerns about the two nominees. However, Musau and Minayo argued that the Ministry did not follow the correct procedures and failed to give them a fair hearing.

    This ruling is being seen as a win for fairness and transparency in government appointments. It also reinforces the importance of following due process when selecting members of key regulatory bodies.

    Once the court order is followed, Nzau Musau and Lucy Minayo will officially join the Media Complaints Commission, which handles complaints and issues related to the media industry in Kenya.

    Legal experts say the decision highlights the critical role courts play in protecting constitutional rights and ensuring public appointments are done fairly. The Ministry has not yet responded to the High Courtโ€™s ruling.
