    Gachagua Assembles Elite 20-Lawyer Squad to Fight Impeachment

    Gachagua Assembles Elite 20-Lawyer Squad to Fight Impeachment

    With mounting momentum in the push to impeach Deputy President Rigathi Gachagua, the second-in-command has unveiled a top-notch legal team to contest his ouster.

    Leading this legal team are Senior Counsels Paul Mwite, Victor Swanya, Tom Macharia, Amos Kisilu, and Elisha Ongoya.

    Gachagua’s attorneys, speaking to the press, emphasized their commitment to defending him against all allegations brought forth by the MPs supporting the impeachment motion.

    Specifically, the legal team intends to challenge the decision to allocate only two days for public participation. They argue that this limited timeframe contradicts constitutional requirements for sufficient public input, rendering the process inadequate and ineffective.

    “We have thoroughly reviewed the accusations against His Excellency, the Deputy President, and we are fully prepared,” Swanya told reporters.

    Additionally, Gachaguaโ€™s legal team will demand that National Assembly Speaker Moses Wetangula and his deputy, Gladys Boss Shollei, be removed from the impeachment proceedings, citing their prior statements on the matter.

    The lawyers argue that the Speaker and his deputy, who are expected to remain impartial, have publicly expressed support for Gachagua’s removal, compromising their neutrality.

    “Announcing a notice at the last minute and expecting people to be ready is not fair. For the sake of natural justice, both principal officers should recuse themselves,” Swanya asserted.

    If necessary, the legal team is prepared to escalate the matter to the Supreme Court.

    On Tuesday, October 1, National Assembly Speaker Moses Wetangula announced that Deputy President Gachagua would be allowed to present his defense before a final decision on the impeachment. Gachagua will have two hours on October 8, 2024, to make his case.

    The motion will proceed after the public participation process, which concluded on Saturday, October 5.

    Upon completion at the National Assembly, Speaker Wetangula will notify Senate Speaker Amason Kingi, who will then take over the matter.

    Speaker Kingi will convene a Senate plenary within seven days, during which the motion will be heard. Subsequently, a committee will be formed to investigate the allegations within a ten-day timeframe.
