High Court Rescues Uhuru Wing: Kioni and Murathe’s Expulsion Overturned

The High Court in Nairobi has reversed the decision by a faction of the Jubilee Party to expel its former leadership during the tenure of ex-President Uhuru Kenyatta.

The court affirmed that David Murathe, the Jubilee Party’s Vice Chairperson, will retain his position, despite efforts by some party members to oust him.

Justice Janet Mulwa also reinstated Jeremiah Kioni as the party’s Secretary General, effectively bringing an end to the prolonged internal power struggle within the Jubilee Party.

“Victory as High Court rules that Jubilee Party belongs to Uhuru Kenyatta. Justice Janet Mulwa also nullified the Kanini-Sabina-led NEC that attempted to remove Jeremiah Kioni, David Murathe, and Treasurer Kagwe Gichohi,” read a statement shared by Jubilee Party.

The Jubilee Party has been mired in internal conflicts after leaders from a faction led by Sabina Chege, seeking to replace Uhuru Kenyatta, and East Africa Community lawmaker Kanini Kega, attempting to oust Kioni, tried to take over the party.

This takeover also sought to remove former President Uhuru Kenyatta as party leader, causing a significant rift within the party.

The power struggle led to two factions claiming party leadership, prompting Kioni and Murathe’s allies to seek a court order reversing the attempted takeover.

Justice Mulwa ordered that each faction bears its legal costs, meaning neither Chege’s nor Kioni’s side will be fully responsible for all proceedings.

“The appeal No. E630/E635 of 2023 has been allowed in its entirety. Each party must bear its costs,” part of the ruling stated.

However, Justice Mulwa refused to hold Kanini Kega, Sabina Chege, and Joshua Kutuny in contempt for performing party duties without legal authority.

The faction led by Sabina Chege did not provide a comment on their next steps following the ruling.
