High Court Rejects Bid to Halt Impeachment Motion Against Deputy President Gachagua
The High Court has refused to block Parliament from moving forward with an impeachment motion against Deputy President Rigathi Gachagua.
Former Senator Cleophas Malala, who filed the motion, aimed to prevent the National Assembly and Senate from tabling, debating, or taking action on any motion to remove DP Gachagua from office.
Malala claimed that both Houses lack compliance with the two-thirds gender rule, which he argued violates the Constitution.
Kenyans in Beirut plead for assistance as Israel intensifies attacks on Lebanon. Dismissing the petition, Justice Bahati Mwamuye instructed the National Assembly and Parliament to file their rejoinders by Thursday, October 3, 2024.
He added that Malala may submit his rejoinder by Friday, October 4, if necessary. The case is set for mention on October 7.

Majority Leader Kimani Ichung’wah stated that the impeachment motion will be tabled on Tuesday at 2:30 p.m.
The motion requires 233 MPs to support it for approval, and reports indicate that by the end of Sunday, 302 members of parliament had signed on.
Gachagua is expected to face numerous charges, including violating Article 10 of the Constitution, with his accusers alleging that his public remarks have been inciteful, reckless, inflammatory, and capable of promoting ethnic hatred.
He also faces accusations of breaching Articles 147, 148, 174, 186, and 189 regarding his conduct and responsibilities as the President’s principal assistant.
Additionally, Gachagua must defend himself against allegations of unlawfully acquiring assets using public funds. The properties in question are in Nyeri, Nairobi, and Kilifi counties.
If the motion is successful, National Assembly Speaker Moses Wetangula will notify Senate Speaker Amason Kingi of the decision within two days for further action.
