Businessman Jimi Wanjigi has been granted release on a Ksh10 million personal bond after his arrest and detention at Kamukunji Police Station on Monday.

Wanjigi appeared in court on Tuesday, where the judge ordered him to surrender his passport as the court awaits a ruling on September 12 on whether he will be required to enter a plea.

On that same date, Wanjigi and a co-accused will learn if the charges against them will be dismissed on September 12 of this year.

Earlier on Tuesday, Wanjigi’s legal team sought a postponement of the plea process.

Senior Counsel Paul Muite argued that a prior court order had barred the police from arresting Wanjigi.

He emphasized that the order also required Wanjigi’s immediate release if he had already been detained.

The defense further claimed that, in connection with accusations of illegal firearm possession, the police acted in bad faith and disregarded court orders by revoking Wanjigi’s firearm license, which had previously been reinstated by the High Court.

Lawyer Wallis Otieno argued that the Firearm Licensing Board unjustly revoked Wanjigi’s reinstated license to press illegal firearm charges against him.

Otieno also presented before Presiding Magistrate Susan Shitubi that the charges against Wanjigi were invalid since the police violated court orders by arresting him.

Additionally, Otieno pointed out that Wanjigi was taken into custody despite voluntarily complying with a police summons to meet with DCI officers.

Otieno further alleged that the second accused, Kibe, was subjected to physical abuse by police officers, including painful genital squeezing while in custody.
