    Aden Duale Clarifies Role in KDF Deployment During Anti-Finance Bill Protests

    Aden Duale Clarifies Role in KDF Deployment During Anti-Finance Bill Protests

    Environment, Climate Change, and Forestry CS nominee Aden Duale has emphasized that he did not order the Kenya Defence Forces’ deployment during the anti-Finance Bill protests.

    On Friday, Duale clarified that the decision was made by the framers of the Kenyan Constitution.

    He stated that the deployment adhered to legal provisions.

    He highlighted that the Constitution permits the Defence CS to step in whenever the police are unable to maintain public order.

    “I did not deploy KDF. The framers of the Constitution included Article 241 (3)(b) and (3)(c). So, Kenya Defence Forces are in the streets, in Boni Forest combating al Shabaab, in North Rift addressing banditry, at Westgate during the terror attack, and at Garissa University during the terror attack where we lost many lives,” Duale explained.

    “For peace, public order, and safety, when the police are overwhelmed, Article 241 (3)(b) empowers the Minister for Defence, which was my role at the time. Once invoked, I am required to enact subsidiary legislation and gazette it.”

    The CS nominee was before the National Assembly Committee on Appointments for vetting.

    Duale stated that the Supreme Court and Parliament were under threat on that day.

    He stressed that the KDF’s intervention was crucial in preventing significant loss of life.

    He added that as Defence CS, he could not allow such a catastrophe to occur.

    “That day, the office of the Chief Justice and the Supreme Court as an institution were under threat, as were Parliament and colleagues present here. Without KDF’s assistance, many MPs, including our Speaker, could have perished,” Duale said.

    “Parliament could have been set ablaze. As the Minister of Defence with the Constitutional provision, I could not be that irresponsible.”

    The former Defence CS praised the framers of the Constitution for incorporating Article 241 (3)(b) and (c) in the Kenyan Constitution of 2010.

    “I want to thank the framers of the Constitution. I was involved, the Speakers were involved, and many other members participated. It is now, on June 25, that I fully appreciate the significance of Article 241 (3)(b) and (c),” Duale concluded.
