Nairobi Court Approves Extradition of Murder Suspect Kevin Kang’ethe to the U.S.
A Nairobi magistrate court has sanctioned the extradition of Kevin Kang’ethe to the United States, where he faces charges of first-degree murder.
Chief Magistrate Lucas Onyina approved the prosecution’s request, ordering Kang’ethe’s extradition to the Chelsea District Court in Suffolk County, Massachusetts, for the alleged first-degree murder under Massachusetts General Law, chapter 265, section 1.
Chief Magistrate Onyina validated the prosecution’s argument, stating that sufficient factual and legal reasons supported the extradition, based on the Extradition Treaty between Kenya and the United States.
Justice Onyina highlighted that there were no barriers to Kang’ethe’s extradition to the U.S. as the alleged crime was neither politically motivated nor driven by tribal factors.

The court concluded that the evidence presented significantly linked Kang’ethe to the alleged crime. An affidavit from Senior Prosecution Counsel Magdalene Nduati reinforced the prosecution’s case.
The Office of the Director of Public Prosecutions (ODPP) received an official extradition request on January 31, 2024, from the U.S., facilitated by the Central Authority, including the Attorney General’s Office and the Department of Justice.
Kang’ethe is accused of the murder of Margaret Mbitu in Massachusetts between October 30 and November 1, 2023. He was arrested on January 30, 2024, in the Parklands area of Westlands, Nairobi County.
The prosecution team, headed by Senior Assistant Director of Public Prosecutions Vincent Monda and including Njoki Kihara, J.V. Owiti, Magdalene Nduati, and Fatma Shaban, collaboratively handled the case.
Kang’ethe’s extradition will proceed, and he will be tried in Massachusetts for first-degree murder charges.
