    Terrorism Charges Against Former Nairobi Governor Mike Sonko Dropped Due to Insufficient Evidence

    Director of Public Prosecutions Renson Ingonga has dismissed the terrorism charges against former Nairobi Governor Mike Sonko.

    The charges, filed in 2021, implicated the former county chief and two others, Clifford Ouko and Benjamin Odhiambo.

    They were accused of enlisting unidentified individuals to carry out a terrorist act in Kenya.

    The indictment alleged that on January 31, 2021, in Athi River, Machakos County, the former governor possessed military attire intended for committing or facilitating a terrorist act.

    Additional charges included illegal possession of equipment for committing a terrorist act, violating Section 6 of the Prevention of Terrorism Act, 2012.

    On Wednesday, a ruling at Kahawa Law Courts in Nairobi exonerated Mr Sonko from recruiting individuals for terrorist activities in Kenya.

    Principal Magistrate Daniel Kiage ruled that the evidence was insufficient to connect Mr Sonko to the terrorism allegations.

    “I have reviewed the prosecution’s application and hereby mark the case as withdrawn under section 87A of the CPC,” the court declared.

    In February 2024, a Milimani court also cleared Mr Sonko and 16 others of misappropriating Sh357 million during his tenure as Nairobi governor.

    Milimani Magistrate Eunice Nyutu concluded that there was insufficient evidence showing how Sonko and his co-defendants conspired to misuse county funds.

    “Upon thoroughly examining the testimony of six witnesses, the presented evidence is insufficient to uphold the charges against the accused,” Ms Nyutu ruled.
