Supreme Court Decision Strips Ex-Govt Officer: Ksh113M and 7 Multi-Million Properties Lost

Former Nairobi County Finance Chief Officer Jimmy Kiamba lost multimillion-shilling properties and money in his bank accounts on Thursday, May 23, following a Supreme Court ruling.

The Supreme Court ordered the Ethics and Anti-Corruption Commission (EACC) to confiscate money and property worth over Ksh200 million.

Reportedly, Kiamba had Ksh113.9 million in his bank accounts and owned seven multimillion-shilling properties.

The EACC filed a case against Kiamba, claiming thatย some of his properties were acquiredย illegally.

Kiamba was accused of distributing some of these properties among his family members.

A five-judge bench, including Njoki Susanna Ndung’u, Smokin Wanjala, Isaac Lenaola, William Ouko, and Mohamed Khadhar Ibrahim, dismissed Kiamba’s appeal against a Court of Appeal ruling.

The ruling stated, “The Notice of Motion datedย 22nd Februaryย 2024 and filed onย 4th Marchย 2024, be and isย herebyย struck out.”

The Court of Appeal had previously upheld the High Courtโ€™s decision that Kiamba and his associates possessed unexplained wealth.

EACC spokesperson Eric Ngumbi welcomed the Supreme Court ruling, explaining that the commission initiated the recovery suit after investigations revealed Kiamba’s wealth was disproportionate to his legitimate income, suggesting corrupt acquisition.

EACC stated that Kiamba could not adequately justify the discrepancy in his wealth, leading to the forfeiture proceedings.

Initially, EACC identified 15 parcels of land, seven vehicles, and money in bank accounts, totaling an estimated Ksh872 million.

This figure was later reduced to Ksh575 million, and the Court of Appeal ruling allowed Kiamba to retain Ksh168.7 million worth of his assets.

Kiambaย was accusedย of acquiring the property between 2009 and 2013.
