Youngest Widow of Former Eldoret Politician Kibor Seeks High Court Protection Amid Estate Dispute

The fourth and youngest widow of former prominent Eldoret farmer and politician Jackson Kibor has approached the High Court for legal protection.

Eunita Kibor claims she and her four children have been evicted from their home and are under threat of losing the 300-acre Mafuta farm given to her by Kibor before his death.

In an urgent application, Eunita and her children allege Kiborโ€™s other sons and daughters are conspiring against her to deprive her of her inheritance.

She claims her step-children are violating an existing court order that prevents anyone from tampering with the estate.

However, the accused responded by blaming Eunita for meddling with the estate and disobeying court orders.

Kibor left behind a significant estate valued at over Sh16 billion, which has sparked a fierce succession dispute among his widows and children.

The estate includes over 6,000 acres in Uasin Gishu.

Eunita accuses her step-children of defying the court by interfering with three parcels of land in the estate.

She also accuses them of abuse and cruelty, stating that three months after Kiborโ€™s burial, they unlawfully evicted her and her children from their home.

Eunita argues in her legal documents that her children’s fundamental rights and freedoms have been severely violated and threatened since Kibor’s death.

Kibor passed away on March 17, 2022, leaving behind three widows and 29 children.

Eunita and her children appeared before High Court judge Reuben Nyakundi, who is presiding over the family succession dispute.

Eunita says her eldest son had to interrupt his studies abroad and return home out of concern for the safety of his family.

Justice Nyakundi inquired about the whereabouts of Eunita’s eldest son, who confirmed his return by standing in court.

Eunita, 45, says they have endured violence, torture, abuse, and inhumane treatment from the respondents or their associates.

She also accuses the respondents of threatening her and freezing her bank accounts, preventing her from supporting her children’s needs.

Eunita is represented by Kalya and Company Advocates.

She argues that Kibor provided for her and the four children through income from his rental units in Eldoret and farming activities on the 143-hectare (353-acre) Mafuta farm and other farms totaling about 1,600 acres in Kabenes.

Eunita seeks a court review of the preservation orders issued in November 2022 to specify the land each household occupies, arguing it will protect her and her children.

She also requests the court to bar the eight respondents and any extended family members from trespassing or interfering with the properties she occupies and from collecting rent from Kibor’s rental units.

Justice Nyakundi extended the preservation orders for the estate until the succession dispute was resolved.

He scheduled Eunitaโ€™s application to be heard on May 20, 2024.
