Milimani Verdict: ISIS Terror Operative Found Guilty

The ISIS member was convicted of five charges on April 12 at the Milimani Law Courts.

Mohamed Abdi Ali, also known as Abu Fidaa, Abu Shuhadaa, and Abu Ramzi, faced charges of belonging to the ISIS terrorist organization and arranging a gathering in support of terrorist entities.

Abdi was additionally found guilty of enlisting individuals to join the terrorist organization, gathering intelligence, and possessing items associated with carrying out terrorist activities.

According to Chief Magistrate Martha Mutuku’s ruling under the Prevention of Terrorism Act and the Kenya Citizenship and Immigration Act No. 12 of 2011, the prosecution successfully demonstrated Mohammed Abdi Ali’s guilt beyond any reasonable doubt.

The prosecution presented statements from 26 witnesses, including the Anti-Terrorism Police Unit (ATPU), as well as representatives from the Federal Bureau of Investigation (FBI) in the United States and the Uganda Police.

Under the leadership of SPPC Duncan Ondimu, the prosecution suggested a potential sentence of 90 years, emphasizing the gravity of the crimes and their potential repercussions on the nation.

In further justification, Ondimu pointed out that the vulnerability of the victims, the perpetrator’s intellect, and his intention to utilize technology in committing the offenses constituted sufficient grounds for the sentencing.

The court, however, has cleared two individuals who were accused of the crime.

Abdi Ali was apprehended on April 29, 2016, at his home in Wote Town, located in Makueni County.

The individuals he was accused of were apprehended at Entebbe International Airport in Uganda as part of an investigation linking them to plans to establish an ISIS caliphate in Kenya and East Africa.

Abdi will face his sentencing on April 22, 2024.

The country has registered two alleged terror attacks in the past month. A total of 8 lives were lost.
