EX-Cop Sentenced: 15-Year Prison Term for Fatal Majengo Shooting

On Friday, a former law enforcement officer received a 15-year prison sentence for the killing of 24-year-old Ahmed Majid in the year 2020.

Daniel Mwongela was convicted of the offense on January 15, 2024.

During his sentencing, Judge Daniel Ogembo of Milimani High Court emphasized that the aggravating aspects of the case, such as the loss of a young life, overshadowed any mitigating factors presented by the defendant.

“He deserves a deterrent custodial sentence that will ensure justice to the family of the deceased and to the accused an opportunity to reform,” the judge said.

Justice Ogembo observed that the offender has the right to appeal either the conviction, the sentencing, or both.

During his plea before the sentencing, Mwongela requested a lenient sentence, emphasizing that he played a crucial role as the primary provider for his family, and appealed for a non-custodial punishment.

However, the state objected to the plea, highlighting that the deceased individual had a family, including young dependents who are currently without means of support.

“The accused is not remorseful and still blames the deceased person,” the prosecution added while recommending a custodial sentence.

In the courtroom, it was revealed that the ex-police officer, who was stationed at Shauri Moyo police station during the incident, fired three shots in proximity, fatally injuring the victim after a confrontation on January 16, 2020, in Majengo, Nairobi.

The conflict emerged when Majid attempted to question the police about the arbitrary arrest of a man in the vicinity. The police claimed to have apprehended him for possessing marijuana.

After the incident of gunfire, Majid was transported to the hospital but unfortunately, he did not survive the gunshot injuries.

Majid left behind a wife, 22, and an eight-month-old baby.
