JSC fires warning shot over threats to disobey court orders

The Judicial Service Commission has criticized statements made by officials in the Executive and the legislature contemplating the disregard of court orders.

In a press statement on Monday, Martha Koome, the Chair of the Judicial Service Commission (JSC), expressed that the ongoing assault on the judiciary and the deliberate defiance of court orders amount to an attack on the Constitution.

The Judicial Service Commission commissioners were present at the press briefing.

โ€œThe threats are serious and assault to the constitution and the rule of law and the very stability of any nation and can lead to chaos and instability,โ€ she said.

Koome emphasized the heightened significance of Judicial independence at present, highlighting that persistent assaults pose a threat to the nation, pushing it toward the brink of a constitutional crisis.

โ€œThe declaration that they will not obey the orders granted by the court is unattainable and counts to contempt of court,โ€ she said.

โ€œThe robes that we wear as judges and JSC magnify the conduct and stand out. Judges must be held to a high ethical standard if they are to keep the trust of the people,โ€ she said.

    She further added:

โ€œOur prayer tonight is that we safeguard the constitution according to the law.โ€

Koome emphasized the importance of transparency, diligence, and a dedicated commitment to upholding the rule of law. These factors are crucial in guiding the appropriate execution of their responsibilities and in building public trust in the legal system they are tasked to represent.

The Judicial Service Commission (JSC) affirmed its dedication to addressing corruption within the Judiciary, emphasizing its readiness to address complaints promptly upon their submission.

โ€œIt is the JSCโ€™s firm position that corruption or misconduct of any kind in the Judiciary is addressed with utmost priority,โ€ she said.
