Wavinya Ndeti Takes a Stand Against Government’s Athi River Land Sale Directive

Tuesday, the Machakos County Government issued a warning to all Kenyans planning to acquire East Africa Portland Cement Company-owned land in Mavoko.

The Machakos Ministry of Lands stated in a statement that the county government has not authorized the sale of the contested land.

In addition, the County Government explained that various processes governing the sale of the property, such as surveying and land registration, had not been completed.

The county government of Machakos clarified that it had not received any applications for the subdivision and sale of the land’s development or regularisation.

Further, Ndeti’s administration also underpinned that plans to prioritize squatters, whose houses have been demolished for the last two weeks, during the sale of the land have also not been highlighted by the company.

“The site as settled on has not taken into account the requirements for riparian reserves, wayleaves, and easements under Part IV Section 8(6) Physical and Land Use Planning Development (Permission and Control] [General] Regulations of 2021.

“The said proprietors and entities have not sought consent from the lease to sell or sub-divide the land through the regularisation model. Furthermore, no application for a change of user of the land from agricultural to residential for human settlement has been made,” read the statement in part.

Machakos County Government therefore warned Kenyans entering into a sale agreement with the cement company that the county government will not be held responsible if the process goes south.

Potential purchasers were also advised to await the conclusion of the ongoing court proceedings before initiating any purchases.

The county government’s statement comes weeks after the company announced plans to legalize the sale of the over 900 acres of squatter-occupied land.

Those who had already settled on the land would be granted priority during the process, according to the company.

The 13th of October marked the beginning of demolitions and evictions on Portland Cement land, per President William Ruto’s directive.

Demolitions in Mavoko, Athi River County.
